We had one man who turned to us because his US citizen wife had started abusing him. He was a truck driver in the US who would be the only employed man in the family. 1. One of our clients from Russia was not into politics, but because she had followed a political topic on social media, she did write negative comments referring to the government. Soon she was brought to responsibility for the negative opinion she expressed about the government and corrupt authorities. The removal of the comments did not help. She was able to flee the country as a result of the non-stop questioning and threats from her employer. Soon, we were able to help her remain legally in the US, under legal protection by the government.

2. We had a client who had Russian and Uzbekistan citizenship. He was ethnically Tajik. He had to flee Uzbekistan because authorities would not let him freely run his business, constantly fining and harassing him because he was of Tajik background. When he complained to the police exposing the corruption and fighting for his basic civil and economic rights, his business was taken away from him by authorities. He had to flee to Russia, where he obtained citizenship. Due to the rise of some nationalistic discrimination movements in Russia, he was attacked and beaten severely for being in Russia. He was not welcome in either of his homelands. After he turned to us, we explained to the US government his personal situation in detail and soon he was granted asylum in the US and was allowed to remain in America calling it his new homeland.

3. One of our clients came to the US from Ukraine. He was a member of the Baptist church there. He and his wife were attacked and harassed multiple times for attending their religious ceremonies. We had a client who had a problem learning English. She had been in the US for 7 years already. She had been trying to learn but always had a problem utilizing and remembering simple things. She was later referred to a doctor who diagnosed her with severe stress and depression. He provided a documented medical form (N-648) which waived her obligation to take the Naturalization exam. 1. A couple came to my office and said that they had been together for over four years. However, they had nothing to show for it on paper: there was no shared health insurance, no children, no jointly acquired property, they did not even have a stable place to live. The husband lost his job after the couple got married, and they went through a very difficult time together. However, the USCIS, instead of trying to understand the circumstances of their marriage, demanded "proof" of joint assets, birth certificates of children, life insurance policies, etc. The couple were also summoned for an interview. This frightened the couple.

We met with the couple before the interview and first went through all the documents they had submitted for consideration. Also, we provided recommendations about supporting documents that could be obtained prior to the interview and started to prepare for the interview. We discussed the couple's concerns and possible questions during the interview. We went over the sensitive parts of their case and, step by step, considered all the possible questions. On the day of the interview, the couple arrived on time, they were calm and confident. They successfully passed the interview without any problems and received their 10-year green card within two weeks.

2. Sherzod arrived at our office and told us about his situation. He received a green card through a marriage which was less than 2 years old. He received a conditional green card valid for a period of 2 years from the date of issuance of his green card. He got divorced soon after he received his green card. He did not know what to do. We explained to him that he needed to file an I-751 Petition to Remove the Conditions on Residence. We explained to him that if they, as a couple, were still in a marital relationship, they would file a joint I-751 petition within 90 days before his green card expired, documenting the bona fide nature of the marital relationship. But because there were difficulties in the marital relationship, Sherzod - the green card holder - could file a petition to waive the joint filing requirement of I-751. 

The most common basis for waiving the claim may be proof that the divorce was final and that the marriage was consummated in good faith at the time of consummation. 

We represented Sherzod as our client on an I-751 petition. They dated, worked, lived together for several years and had extensive documentation to prove the bona fide nature of their relationship. In support of the petition, we attached joint tax returns, bills, leases, insurance, bank statements, photographs, and affidavits supporting their relationship and the reasons why the marriage did not work out. As a result of our efforts, the I-751 petition was approved without an interview and our client received a permanent green card, which later developed into US citizenship.

After attending a marriage-based interview at the USCIS Field Office, the couple was informed by an immigration officer that the immigration records revealed that the beneficiary (the wife) did not include the fact that she was divorced when she applied for a B2 tourist visa. She provided inconsistent information and could not explain the situation. We helped the couple to apply for a waiver for fraud and wilful misrepresentation upon the request of the USCIS.
